AI Act and AS 1146 -3

On May 20, 2024, the Italian Government submitted to the Senate the government-initiated bill AS 1146 on “Provisions and Delegation to the Government on Artificial Intelligence.” The bill is currently under consideration in committee.

The Italian Data Protection Authority was heard by Senate committees on July 24 (web doc. no. 10037983) and issued an opinion at the request of the government on August 2 (web doc. no. 10043532).

The previous bulletins of September 5, 2024 and September 19, 2024 detailed the interactions between Regulation (EU) 2024/1689 (“AI Act”) and the future national law, the analysis of some initial adaptation regulations already contained in the bill currently under discussion, as well as the regulations on the use of AI systems in healthcare.

Introduction to Bill AS 1146
– Submitted by the Meloni government on May 20, 20241.
– Purpose: To regulate the use and development of artificial intelligence in Italy.

We conclude with this installment our review of the provisions in Chapter II of the Bill that regulate the use of AI systems in additional areas.

AS 1146 structure

The Bill is divided into six Chapters and 26 articles and-as usual-is supported by an explanatory report. 

The structure in Chapters is made up as follows:

  • Chapter I – Principles and Purpose
  • Chapter II – Sector provisions
  • Chapter III – National strategy, national authority and promotion actions
  • Chapter IV – Provisions for the protection of users and copyrights
  • Chapter V – Criminal provisions
  • Chapter VI – Financial Provisions.
